We respect the privacy of our users and of each person who visits our mobile application The Zaky Mobile App. Here, Nurtured by Design is referred to as (“company”, “we”, or “our”). We are committed to protecting your personal information and your right to privacy in accordance with the General Data Protection Regulation (GDPR). When you visit our mobile application The Zaky (“the mobile application”) and use our services, you trust us with your personal information. We take your privacy very seriously. In this privacy notice, we describe our privacy policy. We seek to explain to you as clearly as possible what information we collect, how we use it, and what rights you have regarding this information. We hope you will take the time to read it carefully, as it is important. If there are any terms in this privacy policy with which you disagree, please discontinue use of our mobile application and our services.
This privacy policy applies to all information collected through our mobile application or related services, sales, marketing, or events (we refer to them collectively in this privacy policy as the “mobile application”).
About Us
The Zaky mobile application is designed to supervise skin-to-skin care and contact between mother and baby in low-resource areas, and to improve its duration and frequency.
It tracks the time parents and caregivers keep their babies skin-to-skin. Track each child’s care sessions by caregivers holding the baby, and review the history.
The mobile application also helps track other newborn activities such as feeding, sleeping, growth, other activities, etc., and to share the account and daily information with different caregivers, in addition to including a learning module. It is NOT considered a medical or healthcare application.
This application is funded by the Bill and Melinda Gates Foundation and Nurtured by Design.

1. WHAT INFORMATION DO WE COLLECT?
Except as set forth herein, this privacy policy does not apply to information collected by a third party (including our affiliates and subsidiaries), including through applications or content (including advertising) that may be linked to or accessible from our mobile application or website.
We collect personal information that you voluntarily provide to us when you register with us, express an interest in obtaining information about us or our products and services, participate in in-app activities, or contact us.
The personal information we collect depends on the context of your interactions with us and the mobile application, your choices, and the products and features you use. The personal information we collect may include the following:
This privacy policy covers our processing of personally identifiable information. This is information that can be specifically linked to you as the individual to whom the information refers. This information may include name, physical address, email address, telephone number, or any other information defined as personally identifiable information (or a similar term) by applicable laws ("personal information"). Personal information does not include personally identifiable information that has been de-identified, pseudonymized, anonymized, aggregated, or processed in such a way as to be non-identifiable (i) so that the data can no longer be attributed to a specific individual, or (ii) so that the data can no longer be attributed to a specific individual (by reasonable means) without the use of additional information, where such additional information is kept separately and is secured to prevent unauthorized re-identification of a specific individual, so that it is not possible with reasonable efforts to link the information to a specific individual (the foregoing will be referred to as "de-identified personal information").
We collect several types of personal information from our users, as explained in detail below, and we use this personal information internally to connect to our services, including personalized service and improvement, to allow you to create a user account and profile, to be contacted by us or other users, and to allow us to respond to your requests for certain products and services, to offer and improve services, and to analyze how you use our services. In some cases, we may also share some of your personal information with third parties, but only as described below.
We are not responsible for the practices of sites linked to the services, and before interacting with these sites, we advise you to consult their rules and policies before entrusting them with your personal information.
In addition, we may also collect information about your use of our websites through various technologies, including cookies.
Identity. We collect passwords, password hints, and other similar security information used for authentication and account access.
Location Information: We track device location by sending GPS coordinates to our applications. We may also determine location using other data from your mobile device, such as wireless network information or cell towers near your device. We use and store your location information to enable several product and service features that rely on location tracking. We may also collect information for troubleshooting, data analysis, testing, research, monitoring, and analyzing usage and activity trends to improve and personalize the services.
Automatically collected information
We automatically collect certain information when you visit, use, or browse the mobile application. This information does not specifically reveal your identity (such as your name or contact information), but it may include information about your device and its use, such as your IP address, browser, device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our mobile application, and other technical information. If you access our mobile application with your mobile device, we may automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information, and IP address. This information is primarily necessary to maintain the security and operation of our mobile application, as well as for our internal analytics and reporting. This tracking uses de-identified personal information (e.g., data that cannot be specifically identified as being associated with you) and does not use your personal information. We will not combine this data with your other personal information without your permission.
Like many companies, we also collect information through cookies and similar technologies.

We may obtain information about you from other sources, such as public databases, joint marketing partners, social networks (such as Facebook), and other third parties.
2. HOW DO WE USE YOUR INFORMATION?
We use your personal information for commercial purposes related to our legitimate business interests ("commercial purposes"), to enter into or form a contract with you ("contractual"), with your consent ("consent"), or to comply with our legal obligations ("legal reasons"). We indicate the specific procedures we rely on for each of the purposes indicated below.
We use the information we collect or receive to:
- Facilitate account creation and login process with your consent. If you choose to link your account with us to a third-party account (such as your Google or Facebook account), we use the information you authorize us to access from these third parties to facilitate account creation and the login process.
- Send you promotional or marketing communications for commercial purposes or with your consent. Our business partners or we may use your personal information that you have sent us for marketing purposes if this matches your marketing preferences. You can decide to stop receiving our marketing emails at any time (see below).
- Send you administrative information related to your account, for our commercial purposes, or for legal reasons. We may use your personal information to send you a product, a service, information about a new feature, or information concerning changes to our rules, terms, and policies.
- Provide you with targeted advertising for our commercial purposes or with your consent. We may use your information to develop and publish content and advertising (and work with third parties to do so) corresponding to your interests or your location and measure their effectiveness.
- Request feedback for our commercial purposes or with your consent. We may use your information to ask you for feedback and to contact you about your use of our mobile application.
- Protect our mobile application for commercial purposes or for legal reasons. We may use your information in our efforts to keep our mobile application secure (for example, to monitor and prevent fraud).
- Allow communication between users with your consent. We may use your information to allow communication between users with the consent of each user.
- Apply our rules, terms, and policies for our commercial purposes and according to legal requirements.
- Respond to legal requests and prevent damage according to legal requirements. If we receive a subpoena or other legal requests, we may need to inspect the data we hold to determine how to respond.
- Other commercial, educational, or research purposes. We may use your depersonalized personal information for other commercial purposes such as data analysis, identification of usage trends, determining the effectiveness of our promotional campaigns, and evaluating and improving our mobile application, our products, our services, our marketing, and your experience.
- Depersonalized personal information : We may share depersonalized personal information (such as anonymous usage data, referring or exit pages and URLs, IP address, platform type, number of clicks, etc.) for educational or research purposes, or with third parties to help them understand the usage patterns of certain services.
When we no longer have ongoing legitimate business needs to process your personal information, we delete or anonymize it, or, where possible (for example, when your personal information is stored in our archives), we securely store your personal information and isolate it from further processing until deletion is possible.
3. WILL YOUR INFORMATION BE SHARED WITH THIRD PARTIES?
We share and disclose your information only in the following situations:
- By Law. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
- Vital Interests and Legal Rights. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
- Depersonalized Personal Information: We may share depersonalized personal information (such as anonymous usage data, referring/exit pages and URLs, IP address, platform type, number of clicks, etc.) for educational or research purposes, or with interested third parties to help them understand usage patterns for certain Services.
- Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work.
- Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
- Advertisers. We may use third-party advertising companies to serve ads when you use the Mobile Application. These companies may use information about your visits to our Mobile Application and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you.
- Affiliates. We may share your information with our affiliates. In which case, we will require those affiliates to honor this privacy policy. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
- With Your Consent. We may disclose your personal information for any other purpose with your consent.
- Other Users. When you share personal information (for example, by posting comments, contributions, or other content to the Mobile Application) or otherwise interact with public areas of the Mobile Application, such personal information may be viewed by all users and may be publicly distributed outside the Mobile Application in perpetuity.
4. HOW DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information.
COOKIES
A cookie is a small text file that a website or mobile application saves on your computer or mobile device when you access the mobile application. In general, a cookie has two main purposes: to improve the browsing experience by saving your actions and preferences, and to help us analyze our website traffic.
We use cookies to help us analyze traffic on the mobile application, to help us improve the performance and usability of the website or mobile application, and to further secure the mobile application. Third-party cookies help us use Google Analytics to count, track, and analyze visits to or usage of the website or mobile application. This helps us understand how people use our mobile application and tells us which areas we need to improve. These third-party cookies do not specifically identify you.
Cookie Control
You are always free to delete cookies that are already on your device via the application settings, and you can choose to prevent them from being added to your device.
5. ARE YOUR DATA TRANSFERRED INTERNATIONALLY?

7. HOW LONG DO WE RETAIN YOUR INFORMATION?
We keep your personal information only as long as necessary for the purposes outlined in the privacy policy, unless a longer retention period is required or permitted by law (such as for tax, accounting, or other legal requirements).
When we no longer have an ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), we will securely store your personal information and isolate it from any further processing until deletion is possible.
8. HOW DO WE PROTECT YOUR INFORMATION?
We have implemented appropriate technical and organisational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the Internet itself is 100% secure. Although we do our best to protect your personal information, transmission of personal information to and from our mobile application is at your own risk. You should only access the Services within a secure environment.
Children Under 13
As noted in our bylaws, we do not knowingly collect, solicit or maintain personal information from anyone under the age of 13 or knowingly allow such persons to register for the Services. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to the Services. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will endeavor to delete that information from our database. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases.
