The Zaky (the "Mobile Application") owned by Nurtured by Design ("We", "us", "our" and "Company") welcomes you.

We offer you access to our services through our "Mobile Application" (defined below) subject to the following Terms and Conditions of Service and Use, which we may update from time to time with or without notice. By accessing and using this mobile application, you acknowledge that you have read, understood, and agree to be legally bound by these terms and conditions and our Privacy Policy, which are incorporated herein by reference (collectively, this "Agreement"). If you do not agree to any of these terms, please do not use the mobile application.

- "Acuerdo" denota estos Términos y Condiciones, Exenciones de Responsabilidad y la Política de Privacidad y otros documentos que le proporciona la Aplicación Móvil;

- All references to the singular include the plural and vice versa and the word “includes” shall be construed as “without limitation.”

- Words used in this document, regardless of the number and gender specifically used, shall be deemed and construed to include any other number, singular or plural, and any other gender, masculine, feminine or non-binary, as the context may require.

- Reference to any statute, ordinance or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments or replacements thereof that are for the time being in force.

- All headings, bold and italics (if any) have been inserted for reference only and do not define boundaries or affect the meaning or interpretation of the Terms of this Agreement.

- Scope. These Terms govern your use of the mobile App and Services. Unless otherwise specified, these Terms do not apply to third-party Services, which are governed by their own terms of service.

- Eligibility: Certain Services of the Mobile App are not available to persons under the age of 18 or to any user suspended or removed from the system by us for any reason.

- Electronic Communication: When you use this mobile App or send us emails and other electronic communications from your desktop or mobile device, you are communicating with us electronically. By submitting, you consent to receive response communications from us electronically in the same format and you may retain copies of these communications for your records.

We reserve the right, at our discretion, to change, modify, add or remove portions of the Terms (collectively, "Changes"), at any time. We may notify you of Changes by sending an email to the address identified in your Account or by posting a revised version of the Terms incorporating the Changes to your Mobile App.

To access the mobile application and utilize its resources, you may be required to provide specific information and create a user ID and password to establish an account.

You agree that the data you provide about establishing an account is correct and that you will keep your data up to date. You are responsible for the security of all your usernames, passwords, and registration information (such as unique account identifiers or historical billing information), and you are solely responsible for any use (authorized or not) of your accounts. You agree to immediately notify us of any unauthorized activity regarding any of your accounts or other security breaches. We may, at our discretion, suspend or terminate any of your usernames and passwords at any time with or without prior notice.

Registration and Access

- The mobile application is free to use.

- Users must download the application from the Play Store for Android users and the App Store for Apple users.

Responsabilidad del contenido

- viole o fomente de manera inapropiada la violación de cualquier ley, norma, regulación u ordenanza municipal, estatal, federal o internacional

- transmita virus u otros archivos dañinos, disruptivos o destructivos

- envíe mensajes repetidos relacionados con otro usuario y/o haga comentarios despectivos u ofensivos sobre otra persona o repita la publicación anterior del mismo mensaje en varios correos electrónicos o temas

- información o datos obtenidos ilegalmente

Cualquier contenido enviado será rechazado. Si se producen infracciones repetidas, nos reservamos el derecho de cancelar el acceso del usuario a la aplicación móvil sin previo aviso.

- There will be no charge for you to use The Zaky mobile application.

- We will be glad to assist you if you have any trouble, you can contact The Zaky team for any queries or issues.

- We take customer feedback very seriously and use it to constantly improve the quality of service.

Por esta aplicación móvil:

Although the information on this Mobile App is accessible worldwide, not all products or services described in this Mobile App are available to all persons or in all geographic locations or jurisdictions. We reserve the right to limit the provision of any service to any person, geographic region or jurisdiction. We may exercise this right as needed. We reserve the right to discontinue any Service at any time. Any offer to provide any Service made on this Mobile App is void where prohibited.

- You must use the Service and the Mobile App for a lawful purpose and comply with all applicable laws while using the Mobile App;

- You may not upload any content to the Mobile App that:

- Is defamatory, infringes any trademark, copyright, or any proprietary right of any person, or affects anyone's privacy, contains violence or hate speech, including any confidential information about any person.

- You shall not use or access the Mobile App to collect market research for any competing businesses;

- You shall not misrepresent or impersonate any person or entity for any false or unlawful purpose;

- You shall not use any device, scraper, or anything automated to access the Mobile App for any purpose without our permission.

- You shall inform us if anything is inappropriate or you may inform us if you find anything unlawful on the Mobile App;

- You shall not interfere or attempt to disrupt the proper working of the Mobile App by using viruses, device, transmission mechanism, software, or routine, or access or attempt to access any data, files, or passwords connected to the Mobile App through hacking, password or data extraction, or any other means;

- You shall communicate to us any inappropriate content of which you become aware. If you discover anything that violates any law, please let us know and we will review it.

We reserve the right, in our sole and absolute discretion, to deny you access to the Mobile App or any service, or any part of the Mobile App.

By accessing or using this Mobile Application, you authorize us to use, store or process your personal information in accordance with our Privacy Policy.

Every effort has been made to ensure that the information offered in this mobile application is accurate and free of errors. We apologize for any errors or omissions that may have occurred. We cannot offer any guarantee that the use of the mobile application will be error-free or suitable for its purpose, timely, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or implies the complete functionality, accuracy and reliability of the mobile application and we offer no warranty, either express or implied, related to suitability for purpose or accuracy.

The Mobile Application contains material, such as software, text, graphics, images, designs, sound recordings, audiovisual works and other material provided by us or on our behalf (collectively referred to as the "Content"). The Content may be owned by us or by third parties. Unauthorized use of the Content may violate copyright, trademark and other laws. You have no right to use the content and will not accept any Content except as permitted by this Agreement. No other use is permitted without our prior written consent. You must retain all copyright and other proprietary notices contained in the original Content on any copy you make of the Content. You may not transfer, license or sublicense, sell or modify the Content or reproduce, display, publicly perform, make a derivative version of, distribute or use the Content in any way for any public or commercial purpose. The use or posting of the Content on any other Mobile Application or in a networked computer environment for any purpose is expressly prohibited.

If you breach any part of this Agreement, your permission to access and/or use the Content and the Mobile Application automatically terminates and you must immediately destroy any copies you have made of the Content.

Our trademarks, service marks and logos used and displayed on the Mobile Application are registered and unregistered trademarks or service marks of ours. Other company, product and service names located on the Mobile Application may be trademarks or service marks owned by others (the "Third Party Trademarks" and, together with us, the "Trademarks"). Nothing on the Mobile Application should be construed as granting, by implication, estoppel or otherwise, any license or right to use the Trademarks, without our prior specific written permission for each use. None of the content may be retransmitted without our express prior written consent for each instance.

You agree to defend, indemnify, and hold us and our officers, directors, employees, successors, licensees from and against any claims, actions, or demands, including, without limitation, reasonable legal and accounting fees, arising or resulting from your breach of this Agreement or your misuse of the Content or Mobile Application. We shall provide notice to you of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit, or proceeding. We reserve the right to assume the exclusive defense and control of any matter which is subject to indemnification under this section. In such case, you agree to cooperate with any reasonable requests assisting our defense of such matter.

DIVISIBILIDAD

Si se determina que alguna disposición de estos Términos no se puede hacer cumplir o no es válida, esa disposición se limitará o eliminará en la medida mínima necesaria para que los Términos permanezcan en pleno vigor, efecto y cumplimiento.

TERMINACIÓN

LEY APLICABLE Y RECURSOS JUDICIALES

Los términos de este documento se regirán e interpretarán de conformidad con la ley de los Estados Unidos de América y el estado de Texas sin dar efecto a ningún principio de conflicto de leyes. Los tribunales del estado de Texas tendrán jurisdicción exclusiva sobre cualquier disputa que surja del uso de la Aplicación móvil.

FUERZA MAYOR

No seremos responsables ante usted, sus usuarios o cualquier tercero por el incumplimiento de nuestras obligaciones o de las suyas en virtud de estos Términos si dicho incumplimiento surge como resultado de la ocurrencia de un evento fuera del control razonable de nosotros, incluido , sin limitación, un acto de guerra o terrorismo, desastre natural, falla de suministro de electricidad, disturbios, disturbios civiles o conmoción civil u otro evento de fuerza mayor.

ASIGNACIÓN

La Compañía tendrá el derecho de ceder / transferir este acuerdo a cualquier tercero, incluida su compañía matriz, subsidiarias, afiliadas, asociadas y compañías del grupo, sin el consentimiento del Usuario.
